1. Introduction
Users of this website, which is operated by TechintheBasket. ("the Company"), are requested to abide by the terms and conditions of use set forth herein. By using this website, you will be deemed to have accepted these terms and conditions.
In the following Terms and Conditions ("Terms"), the words and phrases shall have the following meanings:
1.1. ”The Company” means ”TechintheBasket”, “TechintheBasket” and “techinthebasket.com.au”, which may be interchangeable in this document. All the names mean TechintheBasket.
1.2. Eligibility to Buy: TechintheBasket only accepts customers aged 18 years or above to place an order. Those who are under 18, can only place an order with the involvement of a parent or guardian.
2. Payment
2.1. All the product prices, coupon amount, as well as shipping cost displayed on the website, are denominated in AUD / NZD.
2.2. The customer must make the payment in full before receiving the order.
2.3. Customers can use PayPal to settle the payment of an order.
2.4. The price you can see on the website is the final price for the product.
3. Shipment and Delivery
3.1. TechintheBasket determines the choices of couriers(Australia Post/ Aramex). All orders will be shipped with trackable service and customers will be able to track the shipment status.
3.2. Any order placed will be shipped to the address specified by the customer during the order process.
3.3. After confirming payment is successful, TechintheBasket will process the fulfillment of an order with an estimated handling time of 6-12 business days. This applies to all available items.
4.Return, Refund, and Cancellation Policy
4.1. If the order is still in the processing status, the customer can request to cancel the order.
4.2. TechintheBasket offers a 14 Days Return Policy for all customers upon delivery of the shipment. TechintheBasket is not liable for any loss or damage to return shipments in transit.
**Due to health and hygiene issues, personal and health care products (i.e. shavers, facial massagers, etc.), headphones and earphones are not covered by our 14 Days Return Policy.
4.3. Customers are encouraged or reminded to review the Return Policy when making an order at techinthebasket.com.au.
5. Warranty
5.1. All products include a 12 months warranty covered by TechintheBasket. All products bought from TechintheBasket are not covered by the manufacturer’s warranty unless a special notice
5.2. All orders are automatically registered for TechintheBasket’s seller warranty, with the valid warranty claim date shown on the invoice.
5.3. This seller warranty DOES NOT apply if the damages caused by accident, abuse, misuse, fire, liquid contact, earthquake, or artificial damage.
- Specific exclusions
Consumable products, such as batteries and films are not covered by the warranty.
Products that are not electronic items or do not consume electricity (e.g. Bags, Lens Hoods, etc.) are also not covered.
5.4. Liability of Warranty
TechintheBasket shall not be liable to:
- postage fees of items sent back to our Melbourne warehouse. TechintheBasket only bears the shipping fees for sending an item back to you, plus the parts and labor costs under the Warranty’s Terms and Conditions;
- any data and information loss and corrupted files during the repair process;
- any changes in settings or the system (firmware/software update) during the repair process;
- any delays due to non-controllable factors (parts of element shortages, bad weather, shipping carrier delays, etc.).

6. Products
6.1. Please rest assured that all products we sell are brand new, original, and sealed in a retail box.
6.2. The packaging or boxing of the product may be slightly different than how it is described or depicted on the website.
6.3. If you are not satisfied and need to return the product, you may refer to our cancellation and return policy for the actual process and procedure.
6.4. We would check each item before sending it out, and follow a very rigorous quality assurance procedure that is fully documented. So the box will be unsealed for warranty activation and quality check purposes. This process is to confirm that the item is in good condition and the buyer does not need to worry about receiving any DOA (Dead on Arrival) case.
6.5. The availability of the product can be found in the content of the product page. The product page should contain the most up-to-date stock status of the product. Most of the products are in stock most of the time but sometimes they do run out due to unpredictable or unexpected events. In case the products you ordered are out of stock, you as a customer will be notified by email and a refund will be issued in the event you have already made a payment. Please take note that the dispatch date displayed on the website is a rough estimation and should be used for reference only.

8. Site Content and User Comments
8.1. TechintheBasket will do all that we can to ensure that the information on the website is up to date and correct. However, there may be times that omissions, inaccuracies, or mistakes may occur. TechintheBasket reserves the right to amend the content in such situations.
8.2. All content that you submit to us unless otherwise indicated, you agree to grant TechintheBasket, the nonexclusive and royalty-free rights to reproduce, modify, publish, and distribute the content throughout any media globally. You also grant TechintheBasket the ability to link you to the content submitted.
8.3. Rights to content submitted by you can be reserved by you if the content is accurate and does not breach any of our Terms. You agree to indemnify TechintheBasket if the content you submitted was unlawful or a breach of these Terms or Terms of external parties.
9. Governing Law and Jurisdiction
9.1. To the extent that any part of these terms of use is found to be invalid, unlawful or unenforceable by any court of competent jurisdiction such part shall to that extent be severed from the remaining terms all of which shall remain in full force and effect as permitted by law.
9.2. By using and buying from this website, you agree that the Australian Competition and Consumer Commission, ACCC, without regard to principles of conflict of laws, will govern these Terms and Conditions, and any other applicable policies or dispute of any sort that might arise between you and TechintheBasket or its affiliates.
10. Losses and Limitation of Liability
10.1. The liability of TechintheBasket as stated in the contract, tort or otherwise arising out of the subject matter of the Contract shall not have amounted to more than the total value of the goods delivered under the contract terms.
10.2. TechintheBasket will be responsible for any losses you suffer as a result of us breaching these conditions if the losses were reasonably foreseeable to both you and us when you commenced using the website, or a contract for the sale of goods by us to you was formed. We will not be responsible for any business losses (including the loss in profits, revenue, contracts, anticipated savings, data, goodwill, or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to either you or us when you commenced using the website or when a contract for the sale of goods by us to you was formed.
11. Waiver
11.1. If these conditions are breached and there's no action taken by us, we still reserve the right to apply to other situations where the same conditions are breached.
